What is the role of EU procurement rules in the nuclear industry?

In the light of recent Regulations which came into force on 20 December 2009, implementing the EU Remedies Directive of 11 December 2007, companies operating in the energy sector should be looking carefully at their procurement procedures. The implementing Regulations significantly increase the risks for public sector bodies and energy companies of failing to advertise and competitively tender contracts. The EU public procurement rules are designed to open up public procurement markets to cross-border competition within the European Union. They apply to public sector bodies and to
private sector utility companies operating on the basis of special or exclusive rights granted to them by the State. The 'mischief’ which the rules aim to prevent is political interference in the award of contracts. In the current economic climate, this prevention of mischief is one that many British companies will have sympathy with, especially in the UK which does not have a recent history of building nuclear power stations.
